Additional points to Augment Revenue and on Law Enforcement

The present election is entirely different from all the previous elections.  Political parties got votes from the poor / illiterates to do good to the rich.  But this time, AAP would concentrate on the educated mass for votes, get elected and work for the betterment of the poor.

In the last 7 years, under the banner of our RIIF Trust, I have deliberated with a number of stakeholders engaged in the indirect tax collection and a few others in allied law enforcement, Direct taxation and Police. Without an inkling of entering into politics, we were seriously considering various options available to combat shortcomings noticed in tax collection and law enforcement.   On the debut of AAP, I am sure that a lot can be done to rationalize the working of government machinery to bring out the best benefit to the common man.  When elected to the Lok Sabha I will be in a better position to make it happen.

  • To fully implement innovative approach utilizing the development in Information Technology.
  • A simple tax system, the common man can understand and comply with, with ease. Most of the exemption notifications are to be withdrawn.  These are the main cause for litigation and explosion of Dockets at every layer of judiciary.
  • In Customs, description of goods to be rationalized and specifically tied with Customs Tariff Heading.
  • Live disclosure of import data under RTI for public scrutiny.
  • Centralized Assessment with the help of data available on screen only.
  • World class facilitations to be offered to bonafide trade, strictly as per law.
  • Every officer is to be empowered exactly to the extent he is held accountable.
  • Lateral entry at the levels of administration and policy making.
  • Span of administrative control to be 6 to 10 subordinates.
  • All back office work to be performed at home offices  – mainly reserved to physically handicapped / women.
  • As far as possible ‘paperless office’ concept to be implemented. All organized sector  stake-holders to mandatorily deal with the department only through Information Technology.
  • All offices will work 24X7.
  • The record [Closed files, registers etc] to be safely kept in warehouses located outside city limits for the purpose of vigilance, prosecution etc.
  • All sale invoices pertaining to gold etc. raised by seller through electronic banking only.

9. Why do you want to contest the election?

  • In obedience to the divine calling I have come forward to contest in the election.
  • In the advent of AAP, the time has come for me to enlarge my boundaries of public service since I live out the ideals of AAP in letter and spirit.
  • Since 2006, one of my colleagues [while in service] and myself have deliberated for hours together, jointly researched and discovered that there is massive evasion of duties and taxes by the influencial section of the society ‘databased adjudication / assessment systemic chanages of administration’ the revenue collection machinery can be rejuvenated.
  • We have conducted extensive informal study  of the indirect tax enforcement and concluded that with the current law unchanged, with the available infrastructure and with the same number of personnel, there is possibility of  doubling the revenue collection or the tax rate can be halved.  I can give a detailed write up to justify our claim which will start bearing fruit within a quarter.
  • By winning the election I would be in a better position to get it implemented by the AAP led government to double the existing revenue from Customs. [i.e. from Rs. two lakh crores to four lakh crores from Customs alone.] If the same is applied to other taxes, either the revenue will be doubled or tax rate halved [i.e. from Rs. 12.5 lakh crores to Rs. 25 lakh crores].
  • Migration of money beyond our borders will also be effectively prevented.
  • Please visit our dedicated site www.rightinformer.org to measure our earnest efforts in this direction for the past seven years.
  • I felt that the 'AAP governing team' might need at least a handful of well experienced, fairly old persons with proven impeccable track record, like me, in order to bring out the CHANGE.

10. Why should you be selected as candidate over other applicants?

You will find me excelling many others on account of:-

  • the fact that from the very next day of my retirement I am in ‘Good Governance Initiatives’ for the past seven years. I am the 'Founder Managing Trustee' and Principal Educator and am relentlessly engaged in exhorting officials to ‘'ENFORCE LAW LAWFULLY’ and educate them of the evil effect of ‘selective enforce  law’.
  • the fact that I performed my official work only within the framework of law without any discrimination of rich or poor – caste or creed.
  • the fact that every one who came into contact with me in my official work or in my NGO activities, are unanimously appreciative of my commitment to be a righteous person and my willingness to help all and sundry with compassion and understanding.
  • my par-excellence integrity, honesty, austere lifestyle coupled with enormous courage to do right according to the written law.
  • the fact that from the student days till now I have headed varied social activities and successfully run them turning out best results to the benefit of all concerned.
  • I entered Govt. Service as a common man, retired as a common man, and continue to live as a common man in a rented house in Chennai – 600048 area,  paying  Rs.6000/-pm.  [Yes. We own an old house in Madurai which is about 500 KM from Chennai, built in 1980 with HBA.]
  • I don’t own any vehicle but occasionally use my daughter’s Activa .  While in service and even now at the age of 66 years,  I travel by public Bus or Train and thereafter reach any place by walk.
  • While in service, I feared none other than God who has my destiny but gave due respect to all my superiors - most of them chose me by name to be part of their teams.  Over a period I got a Brand Name and seldom my superior officers wanted me to do any favour beyond the law.

11. If you have not been selected as candidate. What will you do?

Only because of the impeccable disposition of persons like Arvind Kejriwal, Prashant Bushan and others in AAP I want to enter into politics. Till date I was not a member of any political party, not even a sympathiser of any political party.

So, neither will I contest as independent candidate nor will I try to get ticket from some other party.

I would place my services at the disposal of AAP. In the event of any responsibility to use my expertise is given, I might accept it and be a part of AAP team. Otherwise I will continue to be involved in the ‘Good Governance Initiatives’ and try to fulfil the objects of our RIIF Trust.

12. Why do you think that you will win the election?

  • Riding on the AAP wave, I have a fair chance of winning the election on account of my self-denying and upright government service rendered for more than 3 decades.
  • My helping attitude had benefitted innumerable persons in trade and industry.
  • Even those who suffered on account of their wrong doings are appreciative of my commitment to faithful service.
  • Sriperumbudur Lok Sabha constituency where enormous number of industries is there, happened to fall within my official jurisdiction from 2002 till 2007. Several people in the industry and allied field know me well and they are happy to know that I want to contest in the election.
  •  Many officials met by me in the past seven years as part of my post-retirement ‘good governance initiatives’ are appreciative of my efforts though not all of them did changed their course. I am sure, if approached by me all these persons would vote for AAP.

Above all, I am fully aligned with the ideology of AAP and would use all the strategies of the Delhi election.

In addition, I being a very successful strategist who continue to teach the government officials several strategies for effective law enforcement / Administration,  even where there is multi-cornered opposition / non-co-operation, will evolve new strategies fitting to the need if situation demands.

13. For decentralization of power, have you read the SWARAJ book? What is your opinion about that?

Yes.  I read the entire Tamil version also.  I sincerely feel that the time is ripe for fully implementing the vision contained therein with great success.

If the party system in the local body elections are removed, there would be greater cohesion among the villagers / neighbourhoods.  This will contribute greatly to SWARAJ.

14. What strategies would you adopt to win the election? And how much expenses would be required?

To reiterate, I am fully aligned with the ideology of AAP and am appreciative of the strategies which led victory in the Delhi election. I look forward to addition inputs from the organization to be implemented.

To say in brief, if the concept of SWARAJ as dealt with in the book by Shri Arvind Kejriwal is taken to every individual voter, success is ours.  I will try to put all my efforts towards achieving that.

I would establish a call centre manned by girls to explain in Tamil the concept of SWARAJ to those who enquire about AAP.  The Contact Numbers would be incorporated in all the media materials. I have contacts with a leading TV Channel in Chennai which might give me prime time to speak about AAP and SWARAJ.

I would speak about ‘SWARAJ’ in as many Gram Sabhas, Residence Welfare Associations etc. in the constituency and distribute the booklet being prepared by me extracting very appealing portions from ‘SWARAJ’.  The paper will be newsprint and the booklet would be priced at Rs.2/- to ensure reading.  The booklet would be sold where people alight to enter in the residential areas of the constituency – Bus stops, Suburban Railway Stations etc.  Also the young persons are targeted and the books would be sold at the entrance of Universities, Colleges, IT Parks etc.

Preferably college students who do not have any allegiance to any other political party and persons with disabilities would be engaged on part-time work either in the morning or in the evening paying half of the sale proceeds as pocket money to sell the booklets.

Single colour Posters in MF paper with the image of the Symbol allotted and the picture of Shri Arvin Kejriwal alone would be pasted at all vantage points.  Flexi board carrying the salient features of ‘SWARAJ’ in Tamil will be erected in Railway Stations, Bus Stations on unused structures paying least hire charges.

To admit the truth, I am not conversant with the election propaganda and the actual expenditure involved.  I believe that humility coupled with perseverance wins the race.  So, at the most I may need just half of the permitted expenditure for the Lok Sabha Election.

15. Do you have a team apart from party volunteers? How many team members/volunteers you have in each Vidhan Sabha?

The following apolitical leaders with some of whom I am closely associated with in their activities, have endorsed my willingness to contest the election.  They have large following.  In the event of my getting nomination, they would be more than willing to spare lot of their people to work for my success in the election.

I. Founder Managing Trustee / Principal Educator of Right Information International Forum, a registered Trust established in the year 2007.

  • My penultimate year of superannuation [2006] was tribulation time for honest officials to work and it was apparent that the country was heading towards self destruction – losing the precious freedom earned by the sacrifice of many.  But by the time I retired from service in April, 2007,  my hope revived when I started seeing young people like Shri Arvind Kejriwal,   a few honest direct recruit IRS officers and Shri V.Shanmugam, a foreign Trade Consultant whose daughter is now an IAS officer standing for the right [and a few more unnamed],  entering the arena. [I  had on 24.10.2007 taken a print out of the speech made by Shri Arvind Kejriwal on RTI at Pittsburgh on 20.10.2006 – copy enclosed] Former President’s ‘Vision 2020’ strengthened the hope further.  When I read “After one of the talks delivered by Dr.Kalam, a ten-year-old girl came up to him for his autograph. 'What is your ambition?' he asked her. 'I want to live in a developed India', she replied without hesitation. This book is dedicated to her and millions of Indians who share her aspiration.” I profoundly shouted  “Why not in my lifetime?”
  • So, on May Day 2007,  the very next day of my retirement,   I embarked in ‘Good Governance Initiatives’ –  free Administration & Law Enforcement knowledge transfer, persuasion and guidance. [Our site www.rightinformer.com has attracted  4.5 lakhs unique visits till date. We also maintain a dedicated site for guiding officials www.rightinformer.org].

I was fully involved in the incorporation of the Section 25 Company  ‘Kingdom Human Rejuvenation and Development Centre’ and prepared the syllabus and course study – Excel and Exceed to make the youth employable with soft skills and high moral standards and also to make as  humanized employers.

The sterling witness of Shri Shri Mohan Philip, a social activist and President of Adarsh Rashtriya Vikas Party received wide acclaim. The Preamble in his site http://arvpindia.com/ reads as follows:-

“Today’s political parties are based on caste, religion, charismatic leaders or regional satraps. But we believe that a party should comprise leaders respected for their integrity and knowledge and who have a heart to serve the people. That’s the key characteristic of a party rather than its identification with one issue or one personality.”

X. Even from my elementary school days I was found capable and reliable to handle CARE supplies and issue everyday to the students independently managing the stock. In the High School too I was entrusted with the work of indenting, obtaining reams of paper and other stationery from school office for use by the Typewriting students. No student dared to pilfer even a single paper when I was around. These capabilities are my inborn qualities I inherited from my wonderful parents who were honest and compassionate to every needy person without any discrimination of caste or creed in my village. That is why I was content with what I was paid by the government and I did not take any bribe throughout my service and I did not pay bribe for getting any ineligible favour.

 Customs Clearance – Assessment

How to Doubled the tax Revenue or to halve the  tax rate – feasibility report.

Will be achieved by bringing in systemic changes which would prevent forum shopping of evaders by ensuring zero predictability of assignment of consignment / passenger.

·        As per Para 2 (1) of Publication of Daily Lists of Imports and Exports Rules [Customs Notification No. 128/2004 (NT) Date 19/11/2004 the Commissioner of Customs shall publish or cause to be published in such manner as he deems fit, a list of all goods imported into or exported from a port functioning on the Electronic Data Interchange (EDI) system. --Daily list of imports – (i) Port or country of origin of consignment. (ii) Description of goods. (iii) Quantity of goods. (iv) Value of goods. (v) Names of the steamers.

At present the job is entrusted to the private sector.  If the details are published by the department immediately a Bill of Entry is filed, even before clearance anybody who notices evasion can alert the Customs Department intelligence wing in writing.  This would deter many importers from grave undervaluation or false or misleading or insufficient description of goods.

  • Accountability: The immediate superior officer is responsible to assign specific work  in writing and he should provide the necessary updated copy of acts, rules, regulations etc. to be enforced as well as infrastructure and logistics.

·        Wherever appeal is provided for in law for any aspect of work, the proper officer alone will do the original work and will be responsible for the decision.  [From the magistrates up to the level of Supreme Court Judges, every one individually takes the decision.]

·        The two tier verification process will be done away with.  Proper Officer alone will verify correctness of self assessment. The responsibility of the subordinates would be limited to extending assistance alone.

·        If the importer / exporter is aggrieved he may appeal online. It would be a data-based adjudication by the appropriate authority.

·        If the appellate authority decides that  the proper officer has not done his job correctly according to the law – the appellate authority should make an observation whether it was purposely done warranting action on the officer.

·        Extensive use of IT enabled decision-making process to make it impossible to repudiate an action taken or a recommendation made.

·        The routine inspection or examination of containers will be done away with. Filing of advance Bill of Entry for containerized cargo and selection of  container for examination to be made by random selection by the system – which might say either percentage check from 1 to 100% or even specifically say as to packages are to be examined.  [a very low percentage of containers of acredited clients also will be randomly selected by  subjected to examination.]Such containers will be retained at the port of import and examination of such selected containers will be done at the port premises.  All remaining containers would be allowed to be taken direct to the importer’s premises.  This would save time and fuel.

·        Extending the pre-shipment certificate requirement for all containerized cargo – the surveyor supervising stuffing of the container at load-port needs to make a mention about the manner of  package [whether deal wood box or corrugated carton etc.] at the bottom of  the detailed packing list and also provide a stowage plan. Both these documents are to be produced to customs.

·        Trade participation in self regulation would be implemented by real time display of details of every consignment  immediately on filing the Bill of Entry.  Anybody can view the description of goods, classification and value declared and make complaint to the customs for any mischief.

·        Wherever promotions are given for career progression, assignment of work will not be changed. [Assistant Commissioners are promoted as  Deputy Commissioners as an assured career progression. But  they are placed on par in discharging functions.]

·        Not more than 3 levels in the decision making process.  Depending upon the decision making authority.  [The Clerk/Assistant will open the file and put up to the officer who is to initiate the action – giving a brief of the receipt, the relevant law in force, recommendation according to the law and pass on the decision making authority.

·       Centralized back office work. [Pay and allowances [as being done by IT majors, vehicles [as managed by call taxis], photo copying,

·        Home office for women who would do back office work, process claims by officials and preliminary data verification of claims made by trade.  It is enough the staff complete the minimum quantum fixed for a whole week with flexible timing.  The staff may have to forego transport allowance.

·        Verification of self assessment will be on all India basis – the Bill of Entry would go to the queue of any officer without geographical restriction.  Assignment of function to be modified to that extent.

·        Examination of cargo will be videographed  or at least photographed  to prove the seal is in tact, the  imported item corresponds to the description in Bill of Entry and to identify the officer who examines along with the importer/Broker who presents the cargo for examination. These photographs should be uploaded in the system for record.

9. Why do you want to contest the election?

  • In obedience to the divine calling I have come forward to contest in the election.
  • In the advent of AAP, the time has come for me to enlarge my boundaries of public service since I live out the ideals of AAP in letter and spirit.
  • In the year 2012 itself I have inserted a prophetic exhortation as the last lines of pre-print version of our book ‘Administrative Procedures for Law Enforcement  Officers’ which reads “Our Nation is in the threshold of a spectacular change. Don’t you perceive. It’s just around the corner? So, let us be part-takers of the change!”  And so I take the call and  plunge into politics to become a co-builder of a rejuvenated India - SWARAJ.

Preferablly college students who do not have any allegiance to any other political party and persons with disabilities would be engaged on part-time work either in the morning or in the evening paying half of the sale proceeds as pocket money to sell the booklets.

Single colour Posters in MF paper with the image of the Symbol allotted and the picture of Shri Arvin Kejriwal alone would be pasted at all vantage points.  Felxi board containing the salient features of ‘SWARAJ’ in Tamil will be erected in Railway Stations, Bus Stations on unused structures paying least hire charges.
